Edo Elections: PDP Protests Siege on Governors By Security Agents

    September 18, 2020

    Press Statement

The Peoples Democratic Party (PDP) protests the clampdown on its governors by security agents in Benin City, Edo state capital, ahead of Saturday’s governorship election.

The national leadership of the party, in a press conference addressed by the PDP National Chairman, Prince Uche Secondus, alerted the nation and the international community of the security siege on PDP governors in their lodging in Benin City.

The party expressed shock that security agents were detailed to surround the lodging of our governors to harass and intimidate them, whereas APC governors, including the governor of Kano state, Abdullahi Ganduje, his Imo state counterpart, Hope Uzodimma as well as the Deputy President of the Senate, Senator Ovie Omo-Agege, are left free in the comfort of the residence of the sacked national chairman of the APC, Adams Oshiomhole in GRA, Benin City.

Our party considers this siege as provocative and completely unacceptable as there cannot be two sets of laws for the citizens of our nation. In as much as the APC governors are given the liberty to stay in Benin City, our governors must not be harassed or stampeded to leave the state.

At any rate, we are confident that our governors will not allow themselves to be stampeded.

The PDP calls on all stakeholders in the Edo governorship election, particularly the security agencies, to work towards a peaceful, credible, transparent, free and fair election on Saturday.

  • Hon. Jarigbe A. Jarigbe And Related Matters Arising In PDP – By Vena Ikem

Hon. Jarigbe A. Jarigbe And Related Matters Arising In PDP – By Vena Ikem

At the close of yesterday, after pondering some of the comments I read on the social media, I woke up with the mindset to rather enlighten and inform because most people are actually ignorant of the issues surrounding the burning concerns in PDP Cross River State. Funny enough people on both sides of the divide. This is understandable, given the many cases in Court, the incoherence of the NWC with regards to the simple matter of party executives and of course the Govt’s refusal to play by the rules of the game unless it’s “victory” for her!

    The facts and issues first!

    1. The wards and chapter Excos of the party that were elected in February this year were bugged down by some controversies until all activities leading to the state congress were terminated due to covid-19 pandemic.

Subsequently, sometimes in April or so the list of the executive as approved by the NWC was released alongside other state’s Excos for inauguration. The list was essentially of the Excos from the Gov, and the National Assembly members. The Gov protested that he as the Leader of the party has to have 100% of all the Excos or nothing!

The Excos were inaugurated despite his protest as the process was well on it’s way. The inauguration was adjudged as being in order and due process followed as set out in the guidelines, given the covid-19 situation.

In all subsequent hearings and inquiries conducted by the NWC, it was clearly evident that the list of Excos is the legitimate outcome of the Congresses, promoting the NWC ( NOS) to stamp it “Authentic”! giving rise to the acronym we have adopted to subsequently address the said list of Excos.

    2. The Legal Battles begin…

Some chapter Chairmen, were fronted( ostensibly by the PDP CRS and allegedly sponsored by the Gov), as litigants the same day and went to the High Court in calabar to challenge the authenticity of the Exco. They were granted an Injunction on an ex parte application, restraining the PDP from inaugurating the Excos that had been inaugurated earlier that morning against all known legal process.

Subsequently, some chapter Chairmen who were inaugurated applied to the Court to be joined in the suit as defendants so that they could defend their Election.

Justice Eneji granted the said request as he should.

In addition he granted an Order discharging his earlier ex parte order restraining the party from inaugurating the Excos. When, however Counsel to the defendants went to obtain the written order, the judge possibly realized that he had contravened the understanding he must have had with the Gov’s People and refused to sign the Order..

Before the next adjourned date, to the utter embarassment of all, the Judge had allowed the Gov’s People to sneak back and again apply for and obtain the same order he had earlier discharged!

On the next adjourned date, counsel for the defending PDP chapter Chairmen, Barrister Mba Okweni ( SAN) leading Attah Ochinke, former Attorney General and others, applied for a transfer of the case from Justice Eneji being that he had clearly acted in a manner that could not guarantee a fair trial. The judge granted the order as he should and transferred the case file to Justice Elias Abua.

Justice Abua was similarly made to issue another ex parte order restraining the defendants from inaugurating the Excos, against all known practices because the inauguration had long taken place some two months or so earlier, making the urgency for which such an order should be granted non existing!

Subsequently, Justice Elias Abua sitting as vacation judge, after sneaking in an order extending the ex parte order restraining the defendants, being that the Courts had entered into their annual Vacation, under pressure from some quarters was again petitioned and decided to wash his hands off the case pleading his integrity!

The matter was transferred to the second Vacation Court sitting at Ikom.

    3. High Court Ikom.

At the resumed sitting at Ikom, the Plaintiffs( PDP Lawyers, surprisingly came and requested for out of Court settlement. It was granted but no efforts were made to create an avenue for settlement. Instead the Plaintiff again sneaked behind the defendants and applied for another ex parte order against the defendants! The judge found it ridiculous and declined and instead offered to put the defendants on notice as should be, being that it was the same Plaintiffs who asked for an adjournment to settle out of court!

At the resumed hearing yesterday, the Judge decided also to wash his hands off the case! He returned the case file to the Chief Judge, whenever one is appointed..

    4. High Court Abuja..

While all the drama was playing out in the Cross River State judiciary, some of the inaugurated chapter Chairmen also decided to take an action at the Abuja High Court, to protect their Mandate.

They successfully obtained an ex parte order restraining the PDP headquarters from interfering with their Election having been duly elected and sworn in as the Exco of the party. The party subsequently filed a defense and protested that order, but the Court extended the Order pending the determination of case.

The Party petitioned the Chief Judge of The FCT judiciary and he directed that the case be transferred to Calabar. Subsequently that directive was rescinded and later reinstated, bringing the case to Ikom vacation Court too.
Nevertheless, the order restraining the party from interfering with the list of Excos as sworn in remains in effect.

    5. Federal High Court Port Harcourt..

As has been said above, the Courts all over the country started their vacation while these legal gymnastics were playing out. Consequently, litigants can only have resort to what we call a vacation Court. Few courts are usually left behind to attend to matters that may arise during the legal vacation. In Cross River State, they are Justice Elias Abua in Calabar and the second Judge at Ikom whose name eludes me momentarily.

For the Federal High Courts it’s in zones. This year the vacation courts are in Port Harcourt for the SS/SE, the Abuja for the North and Lagos for the SW. That’s how we found ourselves in PH.

    6. I first approached the Federal High Court PH seeking amongst other things to set aside my purported Disqualification from contesting at the state congress and an order restraining the party from interfering with the list of delegates to that congress as that would jeopardize my chances at the Congress. Since that matter is sub judice and as a party in the case I will not comment much on it. Suffice it to say that one interloper in Pius Awah wrote a letter to the Chief Judge of the Federal High Court alleging that the judge had been compromised, on the day judgement was to have been delivered. I describe Mr. Awah as such because he is neither a party in the case nor is PDP Cross River State. My purported disqualification is from Abuja and so I sued PDP HQ. He has also forgotten that he is no longer the State legal adviser of the party their tenures having expired since May. Holding on desperately as “Caretaker Committee” doesn’t confer him any status as “Legal Adviser”! Maybe he doesn’t know. In any case the National Legal Adviser disowned him in open Court as having no such authorization to write such a letter on behalf of the Party! We are awaiting further directives from the Federal High Court, Port Harcourt.

    7. Hon. Jarigbe at the Federal High Court PH.

Hon. Jarigbe again sought the order of the Court restraining the party from interfering with the list of party Excos as there was information that the NWC was contemplating such an action under pressure from the Gov of CRS and alleged. The order was granted..

After Hon. Jarigbe’s clearance , for some strange reason, Hon.. Pius Awah wrote a letter to the Screening Apeal Committee claiming that the PDP in CRS didn’t clear Hon. Jarigbe or something to that incoherent effect.

On the basis of this, the so called screening Appeal Committee purported to have disqualified Hon. Jarigbe ,for having taken the party to court, against their clear mandate.

Hon. Jarigbe appealed to the NWC alleging bad faith. He also filed another action at the Federal High Court to set aside the purported disqualification. The order was granted, clearing the way for him to contest.

    8. The NWC in embarrassment, apparently, decided to turn the process against Hon. Jarigbe. They looked the other way and accepted the result from a faction of the panel against the background of unwarranted intimidation, violence and death of at least two delegates to the Congress and without consideration for the INEC monitoring Report. Clearly, the panel did not use the authentic list of party delegates as confirmed by the NWC and ordered by the Courts.

    9. Hon. Jarigbe promptly went back to the Federal High Court and obtained an Order stopping the Party from forwarding the name of the purported winner to INEC as well as stopping INEC from accepting any name forwarded apart from his own, pending the determination of the case in court.

The matter comes up today in PH.

10..With this I hope you can separate the myths from the facts.

We did not choose to go to Court in PH because of anyone. We went to the Federal High Court with Jurisdiction to hear our case.

In all the Courts we have been to we have won. Those who didn’t have the courage to do justice to our cases as required at least had the decency to wash their hands off the cases, maybe not unlike Pontius Pilate!

Those who deceive you that Hon. Jarigbe is out of contention are telling you half truths. The NWC is unfortunately acting a script to justify certain allegations that we would rather not believe because their exalted position demands equal treatment of aspirants so as to put forward the most acceptable candidate for the party.
That’s the only way to guarantee victory at the polls and ensure that Justice is served..

Zana Akpagu To Seek Legal Redress If The Photocopy Of INEC Nomination Form Bearing Joe Agi’s Name As Circulated On Social Media Turns To Be True

    By Elijah Ugani – Calabar

A frontline contender for the ticket of the All Progressive Congress APC,  for Cross River Northern senatorial district bye election comes 31stOctober, 2020, Prof. Zana Akpagu has called on his teeming supporters to remain resolute despite the sighting of the photocopy of a document that have a semblance with the independent National Electoral Commission INEC nomination form.

Prof. Akpagu maintained that they will not hasitate to take legal action to reclaim their mandate should the document turn out to be true.

In release made available to The Lumine News and signed by Mr. Peter Inyali, for Prof. Zana Akpagu Campaign Organization, calls on all supporters to remain calm as they are yet to ascertain the authenticity of the said document considering the fact that the document beared 9th September, when the Appeal Panel sat for the first time on the 8th September, 2020.

The release reads in parts “Truth Can Only Be Delayed, Not Denied.

“The attention of Prof. Zana Akpagu Campaign Organization has been drawn to a photocopy of Independent National Electoral Commission (INEC) Senatorial Nomination form bearing the name of one Joe Agi, SAN as candidate of the All Progressives Congress (APC) for Cross River North Senatorial district bye-election circulating online.

“We want to urge all our supporters to remain calm as we are yet to confirm the authenticity of the said document. This is necessary because the said document beared September 9th yet the primary appeal panel sat for the first time on 8th and the aspirant whose name appeared on the form was attended to on the 9th.

“The panel report was possibly sent to the National working Committee on the 10th for a decision to be taken on the 11th when they met. We believe that the INEC nomination form could not have been given to anybody when aspirants who appeared before the panel are still awaiting the decision of the national leadership of the party.

“The victory of Prof. Zana Akpagu at the poll was too clear that cannot be subverted. During the panel, the aspirant (Akpagu) presented reports backed with ward and chapter results from INEC, Police, DSS, Observers/Civil Society Organizations that certify his victory.

“With the glaring evidences, we are confident that the leadership of our great party would not fall to the antics of those who are so scared of competition within the party but think they can always use the back door to get the ticket to chicken out in the main election like in the primary to give the PDP a smooth ride.

“Not withstanding, we want to state unequivocally clear that in the event that the document turns out to be true, we won’t hesitate to take the necessary legal action to reclaim our mandate.

“This is democracy hence, the wishes of the people should be allowed to prevail and not the selfish wishes of a privileged few.

While other National Assembly members picked expression of intent forms, Rt. Hon. Legor Idagbo waited for the governor to give him directives to pick the form. Rt. Hon. Legor said he can only pick the form if the governor ask him to do so, you can see the level of support and loyalty he showed to our brother. Whatever, Rt. Hon. Full Text Of Keynote Address By Sen. Sandy Onor On The 2020 World Blood Donor Day Held At UCTH

    By Elijah Ugani – Calabar

TOWARDS A SUSTAINABLE CONTEMPORARY BLOOD DONOR PROGRAM
    By
    Senator Professor Sandy Ojang Onor,
    National Assembly Complex,
    Abuja.

It is a privilege and honour for me to give the keynote to this professionally distinguished audience on this auspicious and remarkable occasion commemorating the World Blood Donor Day.

When I was contacted a couple of weeks ago to give this address, I wondered why I was being honoured, or should I say, saddled with this challenging responsibility considering the fact that though blood flows in my veins constantly, I am a complete “outsider”, and a total stranger in matters connected with the epistemology of blood.

The centrality and criticality of blood to human existence has been known to mankind through time and space. Because of this, nobody can claim total ignorance of the fact that man and his many cousins in the animal kingdom cannot survive without blood; indeed, its inadequacy signals the beginning of the end of life. Beyond this elementary knowledge, many of us, especially scholars of the humanities would not dare to venture into the contentions and contestations among medical and biological experts on blood.

Against all this, I accepted the invitation to deliver this keynote address because of my deep respect for medical personnel who always put their lives on the line for others, not minding the kind of environment in which Nigerian medics work – an environment of severe deprivation, of strains and stresses, of disappointed hopes, and of uncertain future.

I was informed that this occasion is part of the activities marking the 2020 World Blood Donor Day. A quick check on the internet reveals that the World Blood Donor Day is celebrated on 14th June every year to raise awareness on the need for safe blood and blood products and to thank voluntary, unpaid blood donors for their life-saving gift of blood and also to raise awareness of the need for regular blood donations to ensure that all individuals and communities have access to affordable and timely supplies of safe and quality-assured blood and blood products, as an integral part of universal health coverage and a key component of effective health systems. The event is holding in Calabar today due to the postponement occasioned by the novel covid-19 pandemic.

The global theme for this year’s celebration, which has already been held in several corners of the world is “Safe Blood Saves Lives”. It is promoted with the slogan “Give blood and make the world a healthier place.” The idea is to focus on the contribution an individual giver can make to improve health for others in the community. This slogan aims at calling on more people all over the world to become life-savers by volunteering to donate blood regularly.

The three basic functions of blood – transportation of gases, nutrients, waste, cells and hormones throughout the body; protection against diseases through phagocytic white blood cells and antibodies and the regulation of pH, temperature, water content of cells are essential to the proper functioning of the human body. Blood supplies oxygen and nutrients to body cells, remains invaluable in the practice of medicine and in saving the lives of patients. The need for blood by patients is such that every few seconds, someone somewhere will need blood transfusion. Since blood is not manufactured, the need for a robust sustainable blood donor programme cannot be overemphasized.

The good news, according to the World Health Organization (WHO), is that a population’s annual need for blood can be met by 1% of the population who are regular voluntary blood donors. This means that Nigeria with a population of about 200 million needs 2 million regular donors per year, and Cross River state with 3 million needs just 30,000 regular donors, annually.

Lastly, beyond maintaining adequate donor pool, blood utilization must be made efficient to avoid unnecessary transfusions and wastages.
There are several situations that trigger the need for blood. Some of the well-known situations are: blood disorders, pregnancy complications, surgical operations, road traffic accidents, fire incidents, and natural disasters, among others. Timely intervention with transfusion of safe blood in such critical cases is known to be live saving.

Despite current advances in the field of medicine, there are still medical conditions that have no other remedy than blood transfusion. Consequently, there is always the need to make blood available through blood donation. Apart from saving the lives of patients, blood donation benefits the donor as well. The practice of routine blood donation improves the health and well-being of the blood donor as it provides opportunity for a mini health check. The potential blood donor undergoes several medical and laboratory tests which helps him stay healthy, and where any abnormality is detected, early intervention can be commenced.

Furthermore, donating blood reduces excess iron, fat, and cholesterol, while making the bone marrow which produces the blood healthy and active. With these attributes of blood donation, the practice is not only imperative for the blood recipient but presents a win-win situation for both blood donor and recipient.
While blood is vital in several medical conditions, it is important that the blood is both safe and available in a timely manner.

The need for safe blood is universal. Safe blood is critical both for treatments and urgent interventions. It can help patients suffering from life-threatening conditions live longer, with a better quality of life, and supports complex medical and surgical procedures. An adequate supply of safe blood can only be assured through regular donations by voluntary unpaid blood donors. This is why the World Health Organization in 2005 designated 14th June every year as a special day to thank blood donors and encourage more people to give blood freely. But access to safe blood is still a privilege of the few. Most low- and middle-income countries struggle to make safe blood available because donations are low and equipment to test blood is scarce.

Globally, 42% of blood is collected in high-income countries, which are home to only 16% of the world’s population.
Transfusion of unsafe blood could be worse than not transfusing blood at all and as such every effort must be made to ensure the safety of blood. Even as the world marks the 2020 World Blood Donor Day amid the COVIID-19 pandemic, the World Health Organisation which believes that it is still safe to donate blood at this time, however, warned that donors and blood collection centres must apply extra caution and follow laid down requirements during the process. The safety of blood starts from careful selection of blood donor, through adequate testing and processing, to proper transfusion practices. To ensure provision of safe blood, cost is usually incurred especially in testing, and processing of blood. Studies have shown that commercial or paid blood donation reduces the safety of blood and World Health Organization (WHO) condemns sourcing blood from such donors. Thus, the campaign for regular, voluntary, unpaid, blood donation.

Apart from ensuring safety, timely provision of safe blood is equally as important since this may be a determining factor between which patient lives, and which one dies. Blood and blood products are essential to care for women with pregnancy and childbirth associated bleeding; children with severe anemia due to malaria and malnutrition; patients with blood and bone marrow disorders, inherited disorders of hemoglobin and immune deficiency conditions; people with traumatic injuries in emergencies, disasters and accidents; patients undergoing advanced medical and surgical procedures, to mention just a few. This underscores the need for constant availability of safe blood in our health facilities.

A combination of robust blood donation programme and adequate facility for storage is needed to address the challenge of constant availability. Fortunately, the expertise, human and material resources to realize these abound in our environment but need to be harnessed.

There are several challenges militating against development of a robust blood donor programme, as well as timely provision of safe blood. Although challenges exist in the technical, attitudinal, and political aspects, the latter two pose greater problems in our environment. Whereas individuals in developed countries take pride in donating blood, our people are quick to come up with reasons why they will not donate their blood. Some of the reasons put forward include inadequate feeding, fear of developing shortage of blood and some belief in spiritual implications.

Additionally, there are no proper incentives to motivate potential donors, such as recognitions, free tickets to social events or some medical incentives. One of the fundamental aims of the world blood donor day is to encourage people, who might be a bit nervous or unsure about giving blood, to feel encouraged to sign up and start donating, so that the donor population doesn’t decline but stays strong. I use the opportunity of this keynote to appeal to everyone to find out his/her blood type and register as a voluntary, unpaid, blood donor and help make the world a healthier and safer place. We also need to encourage our friends and family to become regular blood donors.

The effort of various International organizations, including the World Health Organization, the International Federation of Red Cross and Red Crescent Societies, the International Federation of Blood Donor Organizations and the International Society of Blood Transfusion, among others, is both commendable and worthy of emulation. Individuals, groups, organizations and governments need to collaborate to save millions of lives annually.

On the political side, there is suboptimal support in terms of legislations, policies, and funding. Funding is very crucial as setting up and maintaining a robust blood donor programme is financially demanding. Budgetary allocation for health sector in Nigeria is a far cry from what is recommended by international communities.

To ensure proper testing and processing, as well as maximize the utility of blood and minimize wastages, several expensive equipment are needed. While not making excuses for government, there is no gainsaying that government cannot do it alone. There is room for everyone (corporate organizations, non-governmental organizations, public spirited individuals and groups, philanthropists, etc) to support the funding of this critical aspect of healthcare, as without funding, mere donation of blood will achieve very little.

At this juncture, I quickly commend the gesture from 1995 graduating class of Calabar University Medical Students Association in building and donating a wonderful edifice to the department of Haematology and Blood Transfusion, UCTH, for blood donation. Members of the public, other alumni and corporate bodies are enjoined to emulate this laudable gesture.

This year’s theme is also a call to action for governments, national health authorities and national blood transfusion services to provide adequate resources and put in place systems and infrastructure to increase the collection of blood from voluntary, non-remunerated blood donors; to provide quality donor care; to promote and implement appropriate clinical use of blood; and to set up systems for the oversight and surveillance on the whole chain of blood transfusion. There is the urgent need to raise wider awareness of the need to increase the availability of safe blood for use wherever and whenever it is needed to save life. Everyone who can donate blood should consider making regular voluntary, unpaid donations, so that people in need will have access to safe blood transfusions, when and where they need them.
Finally, I call on individuals and organizations to assist blood banks to optimize their blood donor recruitment programs with relative ease. This will help to arrest the downward trend in blood collection in the midst of the ever-increasing demands for blood transfusions. On the other hand, governments and non-governmental organizations should give priority to the funding of blood centers, capacity building and manpower training.

As the largest black nation in the world, the Covid-19 experience has taught us that we should give attention to our healthcare institutions. Nobody can doubt that it would be hell for Nigeria if blood transfusion was the gold standard treatment needed for Covid-19 infection. As lucky as we are, we have to admit that the future is unpredictable.

It remains for me to pay special tribute to the Hematology unit of UCTH for its continuing interest in the health and wellbeing of the generality of the people. For the rest of us, I urge us to join the league of voluntary, unpaid, blood donors. Everyone should support this campaign by selflessly donating blood and encouraging others to donate. Special commendations, once again, to 1995 graduating class of Calabar University Medical Students Association for building and donating a wonderful edifice to the department of Haematology and Blood Transfusion, UCTH, for blood donation. There is a new opportunity, as we commission the blood donor centre today, for altruistic donations (both financial and material) towards equipping this blood donor centre.

I therefore urge everyone to key into this uncommon opportunity to give back to society. I wish you remarkable success in this year’s celebration of the World Blood Donor Day. Thank you for your patience in hearing me through. May God who has provided salvation and healing through the blood and stripes of Jesus Christ continue to cleanse us of all sicknesses.
